1. Acceptance

By accessing or using the Smart Money Pros website, trainings, member portal, communications, or any related services (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services. The Services are operated by Sander Puerto and Aracely Puerto, residents of the State of Florida, USA ("Smart Money Pros," "we," "us").

2. Not financial, legal, or tax advice

All content provided through the Services is for educational and informational purposes only. Nothing on this site constitutes financial, investment, legal, insurance, or tax advice. You are solely responsible for any decisions you make.

3. Income disclaimer & no guarantees

Smart Money Pros is not a get-rich-quick scheme and we do not promise overnight income, large profits, or any specific level of earnings. This is a legitimate financial services business model that requires a state-sanctioned life insurance license and contracts with reputable US insurance carriers.

We make no guarantees of results or income. Earnings vary based on each individual's skill, work ethic, market, and time invested. Most people who do not work consistently will not produce meaningful income. Any testimonials, case studies, or examples shown are individual results and should not be interpreted as typical.

4. Independent contractor — not employment

Smart Money Pros does not offer employment, salaries, hourly wages, or benefits. If you choose to join our team, you will operate as an independent licensed life insurance agent. You are paid directly by the IMO or the insurance carrier, in the form of commissions, in accordance with their compensation schedules. You are solely responsible for filing and paying your own taxes as a 1099 independent contractor, for obtaining and maintaining your state insurance license, and for complying with all applicable laws and carrier requirements.

5. Eligibility & accounts

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential.

6. Acceptable use

• Do not misuse, copy, resell, or redistribute our trainings, materials, or member content.
• Do not misrepresent Smart Money Pros, our team, our results, or our offerings to prospects or the public.
• Do not engage in unlawful, deceptive, or abusive behavior on or through the Services.
• Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the platform.

7. Intellectual property

All trainings, videos, designs, logos, text, software, and other materials made available through the Services are owned by Smart Money Pros or its licensors and are protected by intellectual property laws. You receive a limited, revocable, non-transferable license to access them for your personal use within the Services. No other rights are granted.

8. Paid offerings & refunds

Any paid product (including leads packages or memberships) is governed by the terms presented at checkout. Unless explicitly stated otherwise in writing, all sales are final and no refunds are offered for digital products, leads delivered, or completed services.

9. Third parties

The Services may link to or rely on third-party services (IMOs, insurance carriers, payment processors, hosting providers, etc.). Smart Money Pros is not responsible for the acts, omissions, products, or content of those third parties.

10. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

11. Limitation of liability

To the maximum extent permitted by law, Smart Money Pros, Sander Puerto, Aracely Puerto, and our affiliates, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities, arising out of or related to the Services or these Terms, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the 6 months before the event giving rise to the claim, or (b) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Smart Money Pros, Sander Puerto, Aracely Puerto, and our affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law & venue

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Services or these Terms will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Changes

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
